Tucker City Council will discuss extending drive-through moratorium

Cook Out in Tucker Ga Courtesy of Cook Out The Tucker City Council on June is expected to hold a population hearing and first read on an extension of a a temporary moratorium on drive-through facilities and drive-through restaurants through August The moratorium which was enacted in February is meant to give more time to the staff and council who are seeking to review portions of the city ordinances and draft new ordinances related to the regulation of drive-through facilities and drive-through restaurants according to a staff memo prepared in advance of the June meeting This map shows where drive-through businesses right now exist in Tucker Courtesy of City of Tucker The council was also scheduled to hold a final hearing on an application for a Special Land Use Permit for a special events facility that has been operating out of compliance for several years At the council s May meeting the applicant Luxe Events requested another deferral of the application Luxe is requesting the SLUP with three concurrent variances for the property located on a -acre site located at Northlake Parkway It has been operating for at least two years without the needed variances and without an occupational tax certificate According to a staff memo authorities met with the property owner their leasing agent and Luxe Events several times to discuss the SLUP process and the non-conforming use regulations in the zoning ordinance However it took until December of to get the applicant to submit a complete SLUP application Along with the SLUP application the concurrent variance requests include relief of distance separation requirements from residential properties and relief from accessory structure materials and accessory structure location Tucker leaders and the city s planning commission recommended approval of the SLUP and the distance separation variation but denial of the two others The owners of the complex say they are trying to come into compliance but in the meantime wants approval of the variants Tucker staff and its attorney Ted Baggett revealed the council must vote on the matter at the June meeting regardless of whether another deferral is requested The council is also expected to discuss a contract for a commissioned art sculpture for the Tucker Town Green a second read and constituents hearing of an ordinance to adopt the FY operating budget and updated pay structure a resolution to adopt the proposed FY schedule of fees that help theFY operating budget A resolution to amend the FY budget The post Tucker City Council will discuss extending drive-through moratorium appeared first on Rough Draft Atlanta
